Statutory Non-Advisory Disclosure
By law, we must explicitly state that taxoffset.ai is a software technology tool, not a registered tax agent, financial planner, or licensed legal representative. We provide a mathematical calculation engine that automatically structures transactions and runs simulations based on the codified, published formulas of the Australian Tax Act.
We supply the calculation blueprints and the structured ledger files. You and your professional accountant remain the ultimate decision-makers. Always verify your position before lodging.
1. Acceptance of Terms
By accessing or using taxoffset.ai (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must immediately cease using the software.
2. Description of Service & Mathematical Engine
taxoffset.ai parses transaction files, categorizes operational items, and estimates potential deductions using predefined, rule-based algorithms (such as the FBT statutory formula and Director loan tax compliance trackers).
The accuracy of all outputs is strictly dependent on the accuracy and completeness of the raw transactional datasets (PDF statements, CSV ledgers) supplied by you.
3. Subscription Tiers, Billing & Refunds
- Subscription Fees: Our Service is billed on a recurring monthly or annual basis under fixed-tier pricing. No percentage commissions or hidden transactional penalties are ever charged.
- Billing Terms: Billing occurs at the start of your subscription cycle. We offer an ironclad 10x ROI guarantee: if you don't find at least the subscription value in deductions within 30 days, request a full refund.
- Cancellations & Refunds: You can cancel your subscription at any time via your account settings. Subscriptions remain active until the end of the current billing cycle.
4. User Covenants & ATO Compliance
When utilizing taxoffset.ai, you explicitly represent and warrant that:
- You will not upload fraudulent, forged, or unverified ledger logs.
- You remain personally responsible for verifying that any lodgement blueprinted by this Service is checked for compliance against ATO rules.
- You will maintain your accounting credentials securely.
5. Limitation of Liability
To the maximum extent permitted by law (including the Australian Consumer Law), taxoffset.ai and its directors, employees, or affiliates will not be liable for any direct, indirect, incidental, or consequential losses, penalties, tax audits, or interest charges levied by the ATO or any state authorities resulting from:
- Errors, anomalies, or missing columns in raw PDF bank statement uploads.
- Formula interpretations based on evolving tax statutes or unnotified regulatory modifications.
- Loss of access, browser-database corruption, or system downtimes.
6. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of NSW.
